Agreement and scope
These terms apply to every quote, contract and job carried out by Offermomentumgrid, an interior plastering and exterior rendering business based at 60 Cremorne Street, Cremorne VIC 3121, Australia. When you accept a written quote from us, you enter into a binding agreement on the terms set out below.
Nothing in this document overrides your rights under the Australian Consumer Law, the Domestic Building Contracts Act 1995 (Vic) or any other consumer protection law that applies to your job.
Quotes and pricing
Every quote is based on what we can see and measure during a site visit. Quotes remain valid for sixty days from the date shown.
- Fixed price quotes cover the scope written down in the acceptance document only
- Any extra work must be agreed in writing before we carry it out, with a variation price confirmed up front
- Concealed damage, structural issues or hazardous materials discovered mid job will pause the work until we agree a variation
- Materials may be charged at cost plus a stated handling percentage where the quote is issued on that basis
Where a job is quoted by square metre or linear metre, the final quantity is measured against the finished work, not the initial estimate.
Bookings, deposits and scheduling
We reserve time, equipment and trades for the dates confirmed in your acceptance. A deposit of twenty percent may be required for jobs over five thousand dollars to lock in the start date and cover initial material orders.
If you need to move a confirmed start date, tell us as early as you can. A change inside seven days of the confirmed date may mean the deposit is held against materials already ordered and rescheduling costs. We will always try to accommodate genuine emergencies.
Client responsibilities
So the work can be done safely and properly, you agree to:
- Provide clear and safe access to the work area, including parking for trade vehicles where permits allow
- Remove or protect fragile personal items that cannot be covered by our drop sheets
- Disclose known hazards such as asbestos, lead paint, live wiring or structural alteration
- Obtain any owners corporation approval, heritage consent or council permit that the property requires
- Ensure any pets are kept away from the work area and from trades entering and leaving
Payment terms
Invoices for completed work are payable within seven days of issue unless different terms are stated on the invoice. Commercial clients and builders are billed on the schedule agreed in writing for their project.
Late payments may attract interest calculated at the rate set by the Penalty Interest Rates Act 1983 (Vic), and the cost of any debt recovery action is passed on to the client. We accept bank transfer, card and cash, and all amounts are quoted in Australian dollars and include GST where applicable.
Workmanship guarantee and liability
Offermomentumgrid provides a two year workmanship guarantee on interior plastering and exterior rendering completed by our own team. Materials carry the manufacturer's warranty in addition to this. The guarantee does not cover damage from structural movement, water ingress, other trades working on our finish, or normal surface wear.
Our liability for any claim is limited to the value of the work we have actually completed and been paid for. We hold public liability and contract works insurance at levels sufficient to cover typical residential projects across Victoria. Nothing in this clause limits your rights to a remedy under the Australian Consumer Law.
Dispute resolution and governing law
If a disagreement happens, contact us first at offermomentumgrid@gmail.com with the details. We will respond within five working days and try to resolve it directly. If that does not work, both parties agree to try mediation through Consumer Affairs Victoria or an equivalent service before any court proceedings are commenced.
These terms are governed by the laws of the State of Victoria, Australia. Any dispute that cannot be resolved will be heard in the courts of that state.
